Is probationary salary subject to personal income tax?

The answer is HaveProbationary salaries may be subject to personal income tax if they meet the taxable conditions as stipulated by regulations.

According to personal income tax regulations, all income from salaries and wages received by individuals from businesses or organizations can incur tax obligations. Salaries during the probationary period are essentially still income received by the employee from work activities, and therefore may be subject to personal income tax.

However, whether or not actual tax needs to be paid depends on the type of contract, the contract duration, the income level, and the individual's personal deductions.

In other words, when researching taxable probationary salaries, employees should not only consider the amount received but also examine how the company signs the contract and the tax deduction method being applied.

Legal basis

Personal income tax obligations regarding probationary salaries are directly governed by the current Personal Income Tax Law and Circular No. 111/2013/TT-BTC of the Ministry of Finance. In addition, the latest personal allowance deductions are implemented according to regulations. Law on Personal Income Tax No. 109/2025/QH15 This applies to the current tax period. Các trường hợp áp dụng khấu trừ thuế TNCN đối với lương thử việc

Quy định lương thử việc chịu thuế TNCN
Regulations on probationary salaries subject to personal income tax.

If an individual signs a separate probationary contract or a labor contract with a term of less than 3 months, when paying salaries of 2 million VND or more per payment, businesses usually deduct personal income tax at a rate of 10% on the income before paying the employee.

For example: The employee receives a probationary salary of 8 million VND per month.

Since it falls under the category of deduction according to the 10% rate, the business can proceed as follows:

  • Income received: 8,000,000 VND
  • Provisional personal income tax deduction: 8,000,000 x 10% = 800,000 VND
  • Net amount received after deductions: 7,200,000 VND.

This is why many workers find that their probationary wages are being taxed even before signing a formal contract.

Accurately determining taxable income, deductions, and tax reporting obligations requires businesses to keep complete records of documents, payrolls, and employee files. In cases where businesses require assistance with periodic tax audits, preparation, and processing, hire an accountant to prepare tax reports. To ensure that declarations are made in accordance with regulations and to minimize unnecessary errors.

Trường hợp 3: Ký hợp đồng lao động từ 03 tháng trở lên

If a business signs an employment contract of 3 months or more during the probationary period, or a formal employment contract that includes the probationary period, then income from salary is usually taxed according to the progressive tax rate schedule.

In that case, the business will base its decision on:

  • Total taxable income.
  • Tax-exempt items.
  • Personal allowance.
  • Mandatory insurance premiums.
  • Dependents (if any).

This helps determine the amount of personal income tax to be withheld. Therefore, both the company's accountant and the employee should pay attention to the employment contract the employee is currently participating in.

Why is probationary salary often subject to personal income tax deductions?

Vì sao lương thử việc chịu thuế TNCN 10%
Why are probationary salaries subject to personal income tax (10%)?

Many workers believe that since they are on probation, they are not yet official employees and therefore do not need to pay taxes. However, personal income tax is determined based on income earned, not solely on whether an individual has signed a formal contract or not.

For individuals signing probationary or short-term contracts, businesses do not yet have sufficient grounds to apply the progressive tax rate, so they deduct tax according to regulations.

This 10% tax is considered a provisional tax deduction. Employees can file a final tax return at the end of the year to determine the actual tax payable.

If the amount of tax deducted is greater than the amount of tax payable, the individual can apply for a tax refund according to regulations.

Is probationary salary subject to personal income tax if the income is low?

Lương thử việc chịu thuế TNCN không nếu thu nhập thấp
Is probationary salary subject to personal income tax if the income is low?

One issue of concern to many employees and corporate accountants alike is whether low probationary income will be subject to taxation.

In cases where businesses deduct 10% as prescribed, the deduction is not based on the monthly personal allowance but on the deduction conditions for the payment.

However, when accountants finalize personal income tax returns, the tax authorities will review the individual's entire income for the year.

If the total income after deductions is below the tax threshold, the employee may be entitled to a refund of the tax previously deducted.

Therefore, employees should not only look at the tax deductions during their probationary month but also assess their tax obligations based on their total annual income.

Is it possible to make a commitment to avoid having tax deductions applied to probationary salary?

In some cases, employees can make a commitment to have the business temporarily not deduct personal income tax (10%).

Basic requirements typically include:

  • Individuals with income from salaries and wages.
  • Only one source of income at the time of commitment.
  • Estimated total income for the year after personal deductions is below the tax threshold.
  • The individual has registered for tax and has a tax identification number as required by law.

When the conditions are met, individuals can make a commitment using the prescribed form, which the business can use as a basis for temporarily not deducting tax.

However, making a commitment does not mean complete tax exemption. If a tax liability arises at the end of the year, the individual must still file a tax return and pay the remaining tax.

How to calculate personal income tax on probationary salaries: Accountants need to take note.

The method of calculating tax on probationary salaries depends on the withholding method.

Calculation method when deducted 10%

The formula is defined as follows:

Personal income tax to be withheld = Income paid to the individual x 10%

For example: A probationary employee receives 12 million VND. Personal income tax provisionally deducted:

Personal income tax withheld = 12,000,000 x 10% = 1,200,000 VND

Then, the amount received would be:

Actual amount received = 12,000,000 – 1,200,000 = 10,800,000 VND

Calculation method based on a progressive tax rate schedule.

In cases where a progressive tax rate is applied, businesses need to determine:

Thu nhập tính thuế = Thu nhập chịu thuế – Bảo hiểm bắt buộc – 15.5 triệu – 6.2 triệu x số người phụ thuộc

Sau đó áp biểu 5 bậc, cụ thể:

Level  Thu nhập tính thuế/tháng Tax rate Công thức rút gọn
1 Đến 10 triệu 5%  Thu nhập tính thuế x 5%
2 Trên 10 đến 30 triệu 10% Thu nhập tính thuế x 10% – 0.5 triệu
3  Trên 30 đến 60 triệu 20% Thu nhập tính thuế x 20% – 3.5 triệu
4 Trên 60 đến 100 triệu 30% Thu nhập tính thuế x30% – 9.5 triệu
5  Trên 100 triệu 35% Thu nhập tính thuế x 35% – 14.5 triệu

This method is typically applied to employees who sign employment contracts of 3 months or more.
